The following "Terms of Use" set forth the terms and conditions governing access to and use of the Leader's Edge Training website, its services and materials (collectively, the "Site"). Together with our Terms of Service and Privacy Policy, these Terms of Use govern the relationship between Leader's Edge Training and you, the Site visitor, with respect to your use of the Site. Leader's Edge Training, the Site and its partners World Interactive LLC and LSVT Holdings LLC, (collectively referred to hereinafter as "Leader's Edge Training"), provide this website. It is important that you carefully read and understand the terms and conditions of this Agreement. At any time and at our sole discretion, Leader's Edge Training may revise, modify or otherwise update this Agreement by posting an amended version hereof on the Site. Any changes that we make to this Agreement will be effective immediately upon posting. It is your responsibility to periodically check this page for any amendments to this Agreement.**
BY USING THE SITE, YOU AGREE TO BE BOUND BY TERMS AND CONDITIONS OF THIS AGREEMENT (INCLUDING ANY CHANGES, AMENDMENTS AND/OR MODIFICATIONS THERETO) AS THEY EXIST AT THE TIME OF ANY SUCH USE. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT AUTHORIZED TO USE THE SITE.

Terms of Use
Your usage of the Site is subject to and conditioned upon your full compliance with any and all applicable laws, rules and regulations related thereto, including, but not limited to, the following rules of conduct:
Accounts, Passwords and Security
Certain features or services offered on or through the Site may require you to open an account, which is governed by our "Terms of Service" or "TOS", which are incorporated by reference herein. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify Leader's Edge Training immediately of any unauthorized use of your account or password, or any other breach of security. However, you may be held liable for losses incurred by Leader's Edge Training or any other user of or visitor to the Site due to someone else using your password or account.
You may not use anyone else's password or account at any time without the express permission and consent from Leader's Edge Training. Leader's Edge Training cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
Privacy
Leader's Edge Training's Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Use by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.
Links to Other Sites
This Site may contain links to other independent third-party Web sites ("Linked Sites"). These Linked Sites are provided solely as a convenience to our visitors. Such Linked Sites are not under Leader's Edge Training's control, and Leader's Edge Training is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. You will need to make your own independent judgment regarding your interaction with these Linked Sites.
Intellectual Property Rights
You acknowledge and agree that the Site (including any and all content contained therein) constitutes Leader's Edge Training’s intellectual property, and as such, is protected by copyright, trademark and/or other proprietary rights and laws. Except as expressly authorized herein or by separate written agreement with Leader's Edge Training, you agree not to copy, distribute, transmit, display, perform or create derivative works of the Site or any of its content. All trademarks, trade names and service marks on the Site that are not owned by Leader's Edge Training are the property of their respective owners. Leader's Edge Training's trademarks, trade names and service marks include, without limitation, "Leader's Edge Training", and the Leader's Edge Training logo. The trademarks, trade names and service marks owned by Leader's Edge Training or its affiliates, whether registered or unregistered, may not be used in connection with any product or service in any manner that is likely to cause confusion or dilution. Nothing on the Site should be construed as granting (whether by implication, estoppel or otherwise) any right or license to use any of Leader's Edge Training's trademarks, service marks, copyrights or patent rights without the express written permission of Leader's Edge Training.
Subject to your full compliance with this Agreement and acceptance of the terms and conditions hereof, Leader's Edge Training grants to you the following limited, personal, revocable, non-transferable license (without the right to sublicense): (i) to access the Site via the Internet solely for purposes of viewing posted content, using any free content or services or purchasing any of the Site's fee-based products and services contained therein; (ii) to print out pages of the Site for your personal, non-commercial use; and (iii) to access the site for personal use only and not for commercial exploitation.
SUBJECT TO AND WITHOUT LIMITATION OF THE FOREGOING, ONLY ONE INDIVIDUAL MAY ACCESS A SERVICE AT THE SAME TIME USING THE SAME USER NAME OR PASSWORD, ABSENT LEADER’S EDGE TRAINING’S ADVANCE WRITTEN PERMISSION TO THE CONTRARY. BY ACCESSING THE SITE, YOU ACKNOWLEDGE AND AGREE THAT FAILURE TO COMPLY WITH ANY OF THE TERMS AND CONDITIONS SET FORTH HEREIN – INCLUDING THE FOREGOING – MAY RESULT IN THE IMMEDIATE SUSPENSION AND/OR REVOCATION OF YOUR ACCESS PRIVILEDGES AND MEMBERSHIP TO THE SITE, WITHOUT RECOURSE OR REMUNERATION.
Indemnification and Disclaimer of Warranty
You agree to defend, indemnify and hold harmless Leader's Edge Training, its affiliates and its licensees (and each of their respective partners, employees, representatives and agents) from and against all claims, losses, costs, damages, liabilities, and expenses (including attorney's fees) relating to or arising from your use of the Site, including, but not limited to: (i) any violation of this Agreement; (ii) any improper or unauthorized use of the Materials by you; (iii) any allegation that anything you transmit through or in connection with the Site infringes or otherwise violates the copyright, trademark, trade secret, privacy, or other rights of any third party; and (iv) any liability arising out of your use of the DMCA takedown or other notice functionality available through the Site. Leader's Edge Training shall not be considered your agent or legal advisor in any of the foregoing situations.
ANY AND ALL MATERIALS AND/OR SERVICES ON THE SITE ARE PROVIDED TO YOU ON AN "AS IS" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. LEADER’S EDGE TRAINING, ITS AFFILIATES AND ITS LICENSEES HEREBY DISCLAIM ANY AND ALL WARRANTIES ARISING FROM OR RELATING TO YOUR USE OF THE SITE AND/OR RELIANCE UPON ANY INFORMATION THEREIN (E.G., ANY SEARCH RESULTS, INFORMATION OR THIRD-PARTY CONTENT), INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS.. LEADER’S EDGE TRAINING, ITS AFFILIATES AND ITS LICENSEES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER THEORY, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLES, REGARDLESS OF ANY ADVANCE KNOWLEDGE OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE OR THE MATERIALS IS TO STOP USING THE SITE AND THE MATERIALS AND SERVICES THAT IT OFFERS.
You agree to pay all costs associated with Leader's Edge Training's compliance with third party subpoenas related to your use of the service, including but not limited to costs associated with the following: (i) testimony, (ii) production of documents, (iii) deposition preparation for testimony, (iv) report writing, (v) written or oral disclosures, (vi) engineering and other employee time, and (vii) required travel.
You agree to pay costs associated with log files and custodial or business record certifications, to the extent such information is requested, and that such information shall be provided by email in PDF format.
You acknowledge, agree, and warrant that you have all appropriate rights and ownership to all content submitted to the Site as source content and claimed as an original, and that said content may be used and displayed as a match result for queries made by other users of the Site.
Leader's Edge Training, its owners, affiliates and licensees are not responsible for providing information about the legality of conducting business in your area; it is your responsibility to do so. Any use of the information provided on this Site in violation of any federal, state or local laws is strictly prohibited and may result in the suspension and/or revocation of your membership and access privileges. Leader's Edge Training reserves the right, at any time, to modify or discontinue, temporarily or permanently, the Site (or any portion thereof) without notice and without liability for any resulting damages (monetary or otherwise) regardless of the foreseeability of any such damages.
Violation of these Terms of Use
Leader's Edge Training may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Leader's Edge Training's rights or property, or the rights or property of visitors to or users of the Site, including Leader's Edge Training's customers. Leader's Edge Training reserves the right at all times to disclose any information that Leader's Edge Training deems necessary to comply with any applicable law, regulation, legal process or governmental request. Leader's Edge Training also may disclose your information when Leader's Edge Training determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
You acknowledge and agree that Leader's Edge Training may preserve any transmittal or communication by you with Leader's Edge Training through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Leader's Edge Training determines that such preservation or disclosure is reasonably necessary to (i) comply with legal process, (ii) enforce these Terms of Use, (iii) respond to claims that any such data violates the rights of others, or (iv) protect the rights, property or personal safety of Leader's Edge Training, its employees, users of or visitors to the Site, and the public.
You agree that Leader's Edge Training may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Leader's Edge Training, for which monetary damages would be inadequate, and you consent to Leader's Edge Training obtaining any injunctive or equitable relief that Leader's Edge Training deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Leader's Edge Training may have at law or in equity.
You agree that Leader's Edge Training may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (i) requests by law enforcement or other government agencies, (ii) a request by you (self-initiated account deletions), (iii) discontinuance or material modification of the Site or any service offered on or through the Site, or (iv) unexpected technical issues or problems.
If Leader's Edge Training does take any legal action against you as a result of your violation of these Terms of Use, Leader's Edge Training will be entitled to recover from you, and you agree to pay, all reasonable attorneys' fees and costs of such action, in addition to any other relief granted to Leader's Edge Training. You agree that Leader's Edge Training will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.
General Provisions
This Agreement is governed by and shall be construed in accordance with the laws of the Province of Ontario without regard to its principles of conflicts of law. In the event of a dispute arising under or relating to this Agreement, the Site or the Materials, you agree to the exclusive jurisdiction of the federal and provincial courts located in the Province of Ontario, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
The Site is controlled and operated by Leader's Edge Training from its principal office in Barrie, Ontario and is not intended to subject Leader's Edge Training to the laws or jurisdiction of any province, country, or territory other than that of the Province of Ontario and of Canada. Leader's Edge Training does not represent or warrant that the Site, or any aspect thereof, are appropriate or available for use in any particular jurisdiction. Those who choose to access the Site at their own risk, and are responsible for complying with local laws. We may limit the availability of the Site to any person, geographic area, or jurisdiction we choose, at any time in our sole discretion.
If any provision of this Agreement is found for any reason to be unlawful, void, or unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provision. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof. A party's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. This, together with any of our policies referred to herein, constitutes the entire Agreement between you and Leader's Edge Training relating to your use of the Site; this Agreement supersedes any and all prior or contemporaneous written or oral Agreements between you and Leader's Edge Training regarding the same subject matter (except other written, fully-executed contracts between you and us). Neither the course of conduct between you and us, nor trade practice, shall act to modify any provision of this Agreement. This Agreement is not assignable, transferable or sublicensable by you except with our prior written consent.
